The Indiana Department of Environmental Management (IDEM) has revised the 2012 Remediation Closure Guide (now called the Risk-Based Closure Guide) based on an initial round of external comments. The purpose of the instruction is to describe approaches to investigation and risk-based closure of contaminated or potentially contaminated sites, with the goal being for consistent application of the related Indiana Code.

IDEM is making the new draft, redline comparison version and responses to comments available for public review.

As part of the revision process, IDEM invited external comments on a preliminary draft in 2020. This invitation to comment was prior to, and in addition to, the forthcoming comment period specified by statute as part of the non-rule policy document (NPD) process. The current draft must undergo further internal review and may change before it is made available for additional public comment as part of the standard NPD process. IDEM is not currently soliciting comments on this draft. But when that occurs, a notice of a public comment period for the proposed NPD will appear on the IDEM web site.

In the meantime, please address any concerns to IDEM’s Mike Habeck at mhabeck@idem.in.gov or (317) 234-4791.
