Sen. Mike Braun (R-IN) recently introduced his challenge to President Biden’s vaccine mandate for private businesses with 100 or more employees.
All 50 Senate Republicans joined Senator Braun’s formal disapproval resolution under the Congressional Review Act. This challenge is guaranteed a vote on the Senate floor and could pass by simple majority, meaning that only one Democratic senator would be needed to pass the disapproval resolution through the Senate.
Braun, who indicated the vote will occur in December, has led this effort because he says the mandate is “an indication of where we can go when the federal government gets out of hand.”
The Congressional Review Act allows Congress to overturn certain federal agency regulations and actions through a joint resolution of disapproval. If such a joint resolution is approved by both houses of Congress and signed by the President, or if Congress successfully overrides a presidential veto, the rule at issue becomes invalid.
That’s an unlikely scenario with Democrats in charge of both legislative chambers and the White House, but the Senate Republicans clearly want to send a message on what they see as government overreach.
It was also announced Monday that Biden will delay enforcement of his vaccine mandate for federal employees until next year.
Braun commented on that as well: “President Biden is delaying enforcement of his vaccine mandate for federal workers before he has to deal with its serious consequences. Small businesses around the country won’t have that luxury when his vaccine mandate for private businesses goes in effect, and President Biden should instead abandon this unconstitutional overreach completely.”
