HB 1060 – Office of Administrative Law Proceedings

Allows a petition for review of an agency administrative action to be filed by mail, personal service or electronic mail (current law requires a petition for review to be filed by mail or personal service). Also provides that the filing of a document in an administrative proceeding is considered complete on the date of the electronic submission if the document is sent by electronic mail. Allows an ultimate authority of an agency to request that the Office of Administrative Law Proceedings (OALP) review a motion to disqualify an administrative law judge.

The latest: Heard in the House Judiciary Committee on Tuesday and passed unanimously 12-0; it’s now eligible for further action (second reading) in the House.
Indiana Chamber action/commentary: In communications, we indicated our support for the bill. It provides for streamlining of procedures before the OALP, which was formed in 2019 by HB 1223. COVID-19 has impacted all sectors of our lives including legal proceedings. Service by electronic means, which this bill allows for, provides a convenient and effective method of filing legal documents going forward.
