Non-compete agreements are an essential component of many employers’ efforts to protect their businesses from unfair competition. While non-compete agreements can be, and are, enforced in Indiana, it is all too easy for employers to mis-draft them – causing them not to be worth the paper they are written on. This session will provide an overview of non-compete law in Indiana, discuss the most recent Indiana cases addressing such agreements, provide Indiana employers with tips on how to create enforceable non-competes that will protect their businesses and highlight some of the enforcement challenges arising out of the COVID-19 pandemic.
