FEBRUARY 2013 POSTING UPDATE: The U.S. Department of Labor (DOL) recently issued a final rule implementing new regulations regarding FMLA protections, which were signed into law in 2010. "The first expansion provides families of eligible veterans with the same job-protected FMLA leave currently available to families of military service members and it also enables more military families to take leave for activities that arise when a service member is deployed," according to the DOL. "The second expansion modifies existing rules so that airline personnel and flight crews are better able to make use of the FMLA's protections." The regulations were revised to implement statutory amendments to the FMLA that occurred under the National Defense Authorization Act for Fiscal Year 2010 and the Airline Flight Crew Technical Corrections Act. The FMLA poster is required for all covered employers, which means those with 50 or more employees. Public agencies and public and private elementary and secondary schools are also covered regardless of the number of employees. The regulations take effect March 8, 2013. All poster sets ordered from this point forward will include this update.
What about that NLRA Posting requirement from 2011? That National Labor Relations Act posting was initially mandated as a requirement in fall 2011. Then it was kicked around the court system with different judges giving different opinions as to its legality. (This is why our poster sheet that includes that notice is double-sided.) A final ruling finally came on May 7, 2013, by the U.S. Court of Appeals for the District of Columbia, which struck down the ruling. That means you do NOT need to display the side with that poster (that posting is titled "Employee Rights Under the National Labor Relations Act.").
